Terms of service

1.       INTRODUCTION

 

Welcome to BogeyBros Pte. Ltd. ("BogeyBros", "we", "our" or "Company").  These Terms of Service and Waiver of Liability ("Terms") govern your access to and use of our indoor‑golf simulator venue, equipment, website, booking system and any related products or services (collectively, the "Facilities").  By entering our premises, making a booking, or otherwise using the Facilities, you agree to be bound by these Terms.  If you do not accept every provision, do not use the Facilities.

 

 

2.       DEFINITIONS

 

“You / User / Customer” – any individual who enters our premises, books a session, or uses the Facilities.

 

“Session” – a pre‑booked period granting access to a simulator bay ("Bay").

 

“Member” – a Customer who has purchased a membership or multi‑session package.

 

“Minor” – an individual under 18 years of age.

 

 

3.       SCOPE & ACCEPTANCE

 

3.1   These Terms apply to all bookings made online, by phone, in person, or via third‑party platforms, and to all on‑site use.

 

3.2   Any house‑rules or safety notices displayed in the venue form part of these Terms.

 

3.3   Continued use of the Facilities after any amendment constitutes acceptance of the updated Terms.

 

 

4.       ELIGIBILITY, HEALTH & AGE RESTRICTIONS

 

4.1   Physical readiness. You represent that you are in suitable physical condition to participate in moderate sporting activity and have obtained medical clearance where appropriate.

 

4.2   Minimum age. Users under 16 must be supervised by a responsible adult at all times; Users 16–17 may play unsupervised with a parent/guardian’s written consent.

 

4.3   We may refuse entry to anyone who, in our reasonable opinion, appears unfit, intoxicated, or otherwise unable to participate safely.

 

 

 

 

5.       BOOKINGS, PAYMENTS & CANCELLATIONS

 

5.1   Payments. All Sessions must be paid in full at the time of booking.  Prices include GST unless stated otherwise.

 

5.2   Cancellation window. You may reschedule or cancel a Session up to 24 hours before the scheduled start time for a full credit.  No‑shows or late cancellations forfeit the full fee.

 

5.3   Late arrival. Your Session clock starts at the booked time.  We cannot extend Sessions for late arrivals.

 

5.4   Refunds. All sales are final and non‑refundable except as required by law or expressly set out in these Terms.

 

 

6.       RULES OF CONDUCT & SAFE USE

 

6.1   Only the active player may stand on the hitting mat; all others must remain seated.

 

6.2   Swing only toward the impact screen.  Practice swings off the mat are prohibited.

 

6.3   Use clean, undamaged clubs and balls; throwing clubs or balls is strictly forbidden.

 

6.4   Appropriate athletic footwear is required.  Metal spikes are not permitted.

 

6.5   Food and beverages must be kept away from sensors and electronics.

 

6.6   BogeyBros staff may suspend play or eject any User for unsafe, disruptive, or disrespectful behaviour without refund.

 

6.7   BogeyBros shall not be liable for any injuries or damages sustained as a result of any user’s failure to comply with the stated Rules of Conduct or safety guidelines. Users are solely responsible for ensuring they follow all instructions and use the facilities in a safe and appropriate manner. Any violation of these rules is done at the user's own risk. Pursuant to Section 9, any damage to the simulator’s equipment caused by misuse, negligence, or failure to adhere to safety protocols shall be the financial responsibility of the user. BogeyBros reserves the right to recover the costs of repair or replacement in such cases.

 

 

7.       EQUIPMENT CARE & DAMAGE

 

7.1   You are liable for any damage to the Facilities, simulator hardware, software, screens, turf, furniture, or ancillary property caused by your negligent or wilful acts.

 

7.2   Damage charges will be billed to the payment method used for the booking; if payment fails, you must settle the amount within 14 days of notice.

 

7.3   Cleaning fees may apply if the Bay is left in an unreasonably untidy state.

 

 

 

 

8.       ASSUMPTION OF RISK; WAIVER & RELEASE

 

8.1   Indoor golf involves the use of metal clubs, fast‑moving balls, repetitive motions, tripping hazards, and the possibility of contact with other users or simulator structures. While the simulator is designed with a dampening impact screen to absorb shots under normal use, mishit or misaligned shots may cause golf balls to ricochet unpredictably within the bay.

 

8.2   Individuals in the simulator bay, including those seated in designated seating areas, should remain vigilant at all times. There is a risk that a stray or misdirected shot may enter the seating zone. Users and guests are responsible for their own personal safety and are expected to exercise caution while in the facility.

 

8.3   Users voluntarily assume all risks of injury, illness (including communicable‑disease exposure), and property damage (pursuant to section 9) arising from their participation or presence in the simulator bay. Users are additionally responsible for any damage caused to the simulator equipment due to improper use or failure to comply with BogeyBros’ safety instructions and conduct guidelines, pursuant to section 9.

 

8.4   To the maximum extent permitted by law, you release and covenant not to sue BogeyBros, its officers, directors, owners, employees, agents, contractors, landlords, insurers, and affiliates ("Released Parties") for any and all claims, demands, injuries, damages, losses, expenses or causes of action arising out of or relating to your use of the Facilities, whether arising from the Released Parties' negligence or otherwise.

 

8.5   Nothing in these Terms excludes liability for death or personal injury caused by proven gross negligence or wilful misconduct of BogeyBros, or any other liability that cannot lawfully be limited.

 

9.       Damages

 

9.1   Users shall be financially responsible for any damage to the simulator’s equipment caused by misuse, negligence, failure to follow instructions, or other conduct outside the scope of normal and careful use. BogeyBros reserves the right to recover all repair or replacement costs arising from such damage.

 

9.2   As BogeyBros operates a single simulator bay, any equipment damage that renders the simulator inoperable may result in a complete loss of revenue for the affected period. Where the user is found responsible for such damage under Clause

9.1, BogeyBros reserves the right to claim reasonable compensation for consequential losses arising from downtime. To minimise disruption, users shall make payment on the day of damage. In the event of delayed payment, BogeyBros may charge a downtime fee of SGD $150 per full day of inoperability, representing a fair pre-estimate of lost booking revenue.

 

 

10.   INDEMNITY

 

You agree to indemnify and hold the Released Parties harmless against any claims, damages, costs (including legal fees) and liabilities arising out of (a) your breach of these Terms; (b) your negligent, reckless or wilful conduct; or (c) any claim brought by a third party in connection with your actions while using the Facilities.

 

11.   ACCURACY & INSTRUCTION DISCLAIMER

 

10.1        Our simulators employ industry‑standard launch‑monitor technology.  However, environmental variables of outdoor golf cannot be perfectly replicated; data outputs are estimates only.

 

10.2        Coaching or tips provided by staff are informational and not professional instruction unless expressly stated.  BogeyBros makes no guarantee of performance improvement.

 

 

12.   HEALTH, SAFETY & EMERGENCIES

 

11.1   Follow all posted emergency‑exit and first‑aid signage.

 

11.2   Report any accident, injury, or malfunction to staff immediately.

 

11.3   You authorise us to arrange emergency medical care on your behalf if deemed necessary and agree to be responsible for related costs.

 

 

 

 

13.   PERSONAL PROPERTY

 

12.1  BogeyBros is not liable for lost, stolen, or damaged personal items.

 

14.   PRIVACY & DATA PROTECTION

 

13.1        We collect personal data (e.g., booking details, CCTV footage, swing videos) to operate the Facilities, ensure safety, and for analytics and marketing where you have consented.

 

13.2        Data is retained and secured in accordance with the Personal Data Protection Act 2012 (PDPA).  Refer to our separate Privacy Policy for details on your access and correction rights.

 

 

15.   MEDIA RELEASE

 

14.1  By entering our premises, you grant BogeyBros the right to use your likeness in photographs or video taken in the ordinary course of operations for promotional purposes, without compensation, unless you notify us in writing prior to your Session.

 

 

16.   SUSPENSION & TERMINATION

 

15.1  We may, at our sole discretion, suspend or terminate your access to the Facilities for any violation of these Terms or for conduct we deem unsafe, disruptive, or illegal.  No refunds will be provided.

 

 

17.   SERVICE AVAILABILITY & FORCE MAJEURE

 

16.1  We may close the Facilities or cancel Sessions due to maintenance, technical issues, or events beyond our reasonable control (e.g., power failure, fire, government restrictions).  Where practicable, affected bookings will be rescheduled or credited.

 

 

18.   AMENDMENTS

 

17.1  BogeyBros may modify these Terms at any time by posting the updated version on our website and/or on‑site notice.  The "Last updated" date will change accordingly.  Continued use after changes take effect constitutes acceptance.

 

 

19.   GOVERNING LAW & DISPUTE RESOLUTION

 

18.1        These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.

18.2        Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Singapore courts.  At BogeyBros’ option, disputes involving claims below SGD 20,000 may be referred to the Small Claims Tribunals, and disputes above that threshold may be referred to mediation under the Singapore Mediation Centre before litigation.

 

 

20.   SEVERABILITY

 

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

 

21.   ENTIRE AGREEMENT

 

These Terms, together with any house‑rules, booking confirmations, and the Privacy Policy, constitute the entire agreement between you and BogeyBros regarding the Facilities and supersede all prior understandings.

 

 

22.   ACKNOWLEDGMENT

 

By entering BogeyBros’ premises, making a booking, or otherwise using the Facilities, you confirm that you have read, understood, and agree to be bound by these Terms.
